Conditions of Contract

Copyright

All material remains the property of Copybreak Copywriting Services until final payment has been made on specified project. Until final payment has been made, the Client is prohibited from reproducing, altering or redistributing any material produced by Copybreak in any way. Once final payment has been received the Client secures copyright to the material, however Copybreak retains the right to use any portion of the material for self-promotional interests only. In the event that a project is cancelled at any stage before completion, the Client forgoes all rights to ownership of copyright on any part of the project, regardless of any project payments that may have already been made.

Indemnity

Copybreak relinquishes all responsibility for any legal repercussions which may be incurred on publication or distribution of material by, or on behalf of, the Client. It is the responsibility of the Client to ensure that all information provided is factual and correct. Where Copybreak has created original brand/product names, or company slogans, Copybreak will take all due care to ensure that no existing copyright or trademarks apply, however any applicable search fees will be charged to the Client.

Cancellation Fees

By Client:

In the event that the Client is required to cancel a project, the Client will be obliged to pay for all work completed to date. A penalty fee of 20% for any uncompleted work contained within the Total Quote will also apply at the full rate – discounts and exemptions will not apply. In the event that a project is cancelled by the Client after the Client has signed the Project Authorisation, but prior to commencement of the project, a penalty fee of 20% of the full Total Quote will apply.

By Copybreak: 

In the event that Copybreak is required to cancel a project, the Client will be under no obligation to make payment for any work not completed. Any monies already paid will be refunded in full to the Client. Should the Client wish to use any completed material and secure copyright to that material, the Client may pay for all or any work completed to date.

Rush Fees

Any work deemed urgent and required to take priority over other projects will be subject to a Rush Fee charged at 25% of the total Base Quote. If the project is deemed urgent partway through completion of the project, a Rush Fee of 25% will apply to the remaining portion of work to be completed. 

Payment

Unless prior arrangements have been made, all projects are subject to a pre-payment of 50% of the total job cost prior to Copybreak commencing any project. On completion of the project, payment of the remaining fees is required within 14 days of Final Invoice date. 

Retainer payments are required to be paid in advance on a monthly basis. Projects exceeding the agreed upon hours of the retainer agreement will be charged at the standard hourly rate, subject to the standard Conditions of Contract.
